This privacy policy (hereinafter, “Privacy Policy”) describes the personal data that from or about you, how we use it, and to whom we disclose that information.  By using our website https://www.volta-energysolutions.com (hereinafter: “Website”), communicating with us via e-mail, telephone or fax and/or by applying for a position with us via our Website or otherwise communicating with us in respect of our personnel recruitment process or about job opportunities at Volta, you consent to the practices described in this Privacy Policy.

1. In general

   1. Your personal data is processed by Volta Energy Solutions Canada Inc. (hereinafter,“Volta”, “we”, “us”, “our”). You can contact us via e-mail at it@volta.com
   2. Any notion starting with a capital shall be defined by explicit reference in this Privacy Policy. Where possible given the context, singular words shall be interpreted as also including the plural and vice versa. Any words importing gender shall include all genders.
   3. It is Volta’s policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and / or an individual’s right to privacy are different from one jurisdiction to another.  This Privacy Policy covers those activities that are subject to the provisions of Canada’s federal and provincial privacy laws, as applicable, and it@volta.com.  This Privacy Policy has a limited scope and application.  Consequently, the rights and obligations contained in this Privacy Policy may not be available to all individuals or in all jurisdictions.  If you are unsure if or how this Privacy Policy applies to you, please contact us more information.
   4. Where reference is made to certain laws or regulations, such reference shall also include any change, replacement or annulment of said laws or regulations, including any related executive decisions.
   5. Volta reserves the right to modify, change or amend the Privacy Policy at its own discretion and from time to time. Such modification, change or amendment shall be communicated via the Website. We will provide additional notice to you if we make any changes that materially affect your privacy rights.  If you do not accept the modifications, changes or amendments, you mustinform us by sending an e-mail to it@volta.com.  If we do not receive such an e-mail from you within three (3) business days after the changes to the Privacy Policy have been announced on our Website or otherwise communicated to you, regarding changes that materially affect your privacy rights, you will be deemed to have accepted unambiguously all such changes.

2. Types of personal data we process and how we collect such information

   We collect and use different types of personal data in respect of the individuals with whom we interact and collect such information using different means.  This includes:

   1. Whenever you use our Website, we collect:
      • Information associated with the device you use, such as your IP address, browser type, geographical location and operating system, as well as information collected via the cookies we use;
      • Information concerning your browsing behaviour, such as how long you visit, what links you click on, what pages you visit and how many times you visit a page.
   2. When you fill out the contact form on our Website, or contact us via e-mail, telephone, fax, we collect:
      • The basic identity information you provide us with, such as name, e-mail address, postal address, telephone number, the company you work for, your function;
      • The content of your communication and the technical details of the communication itself, such as with whom you correspond at our end, and the date and time;
      • Publicly available information of your profile on Social Media Channels;
      • Any other personal data you choose to provide to us.
   3. When you apply for a position with us via our Website, we collect:
      • Information you provide in your application, such as your name, address, contact details, including email address and phone number;
      • Information provided in your curriculum vitae (CV) and any other document provided as part of your application such as details of your qualifications, skills, previous work experience, employment history, education, academic achievements and awards, diplomas, certifications, professional memberships, languages, social media accounts;
      • Information you provide during a telephone, video, or in-person interview(s);
      • Information given by the references you provided to us;
      • Information from third parties or public sources (including the internet) necessary to ensure security, prevent fraud or verify the information you or others provide in connection with your application.

3. Purposes for processing your personal data

   We may use and disclose your personal data for the purposes set out below:

   1. To respond to your inquiries and provide you in a personalized and efficient way with the information, products and services you request via the Website, e-mail, telephone, fax;
   2. With your consent, for marketing purposes, including to provide you with targeted communications, promotions, offerings and other advertisements of Volta;
   3. To comply with our legal obligations or to comply with any reasonable request from competent law enforcement agents or representatives, judicial authorities, governmental agencies or bodies, including competent data protection authorities;
   4. To preserve the legitimate interests of Volta, our partners or a third party if and when your registration with or use of the Website or other communication channels can be considered (a) a violation of any applicable terms of use or the intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Website or other communication channels, (c) a danger to the Website or other communication channels or any of Volta’s or our subcontractors’ underlying systems due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (d) in any way hateful, obscene, discriminating, racist, slanderous, spiteful, hurtful or in some other way inappropriate or illegal;
   5. To analyze and monitor our Website’s performance and other related purposes;
   6. To protect us against error, fraud, theft and damage to our property;
   7. To consider you for an employment position or to respond to an employment inquiry, which includes contacting you about employment opportunities, assessing your job application, managing you candidate profile, collecting your feedback on our recruitment matters, verifying your references or otherwise verifying the veracity of your application and/or conducting background checks;
   8. Where permitted or required by appliable law;
   9. Any other reasonable purpose to which you consent.

4. Legal basis for processing your personal data

   1. The processing of your personal data for the purposes outlined in clauses 3.3 is necessary to allow Volta to comply with our legal obligations.
   2. The processing of your personal data for the purposes outlined in clauses 3.1 and 3.5 is necessary for the purpose of the legitimate interests of Volta, which are:
      • Continuous improvements to Volta’s Website, products and services to ensure that you have the best experience possible;
      • Keeping our Website, products and services safe from misuse and illegal activity;
      • Marketing and promotion of our products, services, brands an overall successful commercialization of our products and services.

5. Recipients to whom we disclose your personal data

   1. Volta does not send your personal data in an identifiable manner to any third party without your explicit permission to do so, except as permitted under this Privacy Policy.
   2. We may communicate or disclose your personal data with:
      1. our third party service providers who require such information to assist with the Website and purposes set out in this Privacy Policy. We retain the following categories of service providers:
         • to provide you the Website as well as to process your personal data on our behalf.
         • our corporate affiliates, including parent company and subsidiaries. However, we will ensure that ‘DDI’ entities will take due care that all processing of your personal data is in line with what is set out in this Privacy Policy.
      2. law enforcement in response to subpoenas, warrants, court orders, government inquiries, or investigations; or to comply with relevant laws and regulations.
      3. any another party in the context of a possible change in ownership of, or a grant of a security interest in, all or a part of Volta.

6. Location and transfer of your personal data

   1. Your personal data may be transferred to, or processed in, countries or provinces other than the country or province you are resident and be accessible to the law enforcement and national security authorities of those jurisdictions.  These countries or province may have privacy laws that are different to the data protection laws applicable in your country or province.  However, before transferring or processing your personal data in a foreign country or province, we have taken required safeguards such that third parties provide adequate and/or substantially the same protection of information as those set forth herein and in compliance with applicable law.
   2. Volta may transfer anonymized and/or aggregated data to organizations outside of the country or province where you reside . Should such transfer take place, Volta will ensure that there are safeguards in place to ensure the safety and integrity of your data as well as all rights with respect to personal data you might enjoy under applicable law.  

7. Protection and Retention of your personal data

   1. Your personal data is only processed for as long as needed to achieve the purposes listed under clause 3 of this Privacy Policy or up until such time where you withdraw your consent for the processing of such information. Note that withdrawal of consent may imply that you can no longer use the whole or part of the Website and other communication channels. Volta will destroy or anonymize, your personal data when it is no longer necessary for the purposes outlined in clause 3. If permitted by applicable law, Volta may instead de-identify your personal data when no longer necessary for the purposes outline in clause 3. These actions will occur unless there is:
      • As permited by applicable law, nn overriding interest of Volta, your financial institution, the payment service provider, or any other third party in keeping your personal data identifiable;
      • A legal or regulatory obligation or a judicial or administrative order that prevents Volta from destroying, anonymizing or de-identifying such data.
   2. Volta endeavors to maintain reasonable and appropriate technical and organizational safeguards that are appropriate to the sensitivity of your your personal data. These safeguards are designed to prevent your personal data from loss and unauthorised access or theft as well as accidental loss, tampering or destruction. While we attempt to protect your personal data in our possession, no method of transmission over the internet or security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.
   3. Access by personnel of Volta or our third-party processors will only be on a need-to-know basis and subject to strict confidentiality obligations.

8. Your rights

   Consistent with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country or province of residence.

   1. 1. to you. If permitted under applicable law, Volta reserves the right to charge an administrative fee for multiple subsequent requests for access that are clearly submitted for causing nuisance or harm to Volta.
      2. You have the right to ask that any personal data pertaining to you that is inaccurate and be corrected free of charge. If a request for correction is submitted, we may ask that such request be accompanied bydocumentation evidencing the flawed nature of the data for which correction is asked.
      3. You have the right to withdraw your consent for the processing of your personal data, in which case clause 8.4 will apply.
      4. You have the right to request that personal data pertaining to you be deleted if they are no longer required in light of the purposes outlined in clause 3 or if you withdraw your consent for processing them. However, you need to keep in mind that a request for deletion will be evaluated by Volta against:
         • Overriding interests of Volta;
         • Legal or regulatory obligations or administrative or judicial orders which may prevent such deletion.

         Instead of deletion you can also ask that Volta limit the processing of your personal data if and when (a) you contest the accuracy of that data, (b) the processing is illegitimate or (c) the data is no longer needed for the purposes listed under clause 3 but you need them to defend yourself in judicial proceedings.

      5. You have the right to object to the processing of your personal data if you demonstrate serious and justified reasons related to your particular circumstances that warrant such objection. However, if the intended processing qualifies as direct marketing, you have the right to object to such processing free of charge and without justification.
      6. You have the right to receive from us in a structured, commonly used and machine-readable format all personal data you have provided to us.
      7. If you wish to submit a request to exercise one or more of the rights listed above, you can send an e-mail to it@volta.com. An e-mail requesting to exercise a right shall not be construed as consent with the processing of your personal data beyond what is required for handling your request. Such request should clearly state which right you wish to exercise and the reasons for it if such is required. It should also be dated and signed, and accompanied by a digitally scanned copy of your valid identity card proving your identity. If you use the contact form, Volta may ask you for your signed confirmation and proof of identity.

Volta will promptly inform you upon receiving your request. If the request is deemed valid, Volta shall honour it as soon as reasonably possible, and no later than thirty (30) days after receiving the request.
